Hi Samantha, My father recently passed leaving behind 2 properties for my mother who is beneficiary. There was a living trust drafted several years ago nameing my mother beneficiary and then myself after my mother. As a result of her loss, my mother's health has taken a turn for the worst and I fear she soon may not be able to take care of her own finances. I obtained POA for her in order to help her thru. I have 2 questions 1) How can I transfer title over from my mother to me on the properties to avoid any future legal issues. and 2) I have an older sister who was legally disenherited from the living trust and all assets named within, can she later come back to claim any rights? Thank You, Concerned Daughter

Welcome Guest, As you have the POA, you will be able to get the property transferred in your name by signing a quitclaim deed. You should contact a real estate attorney and he will help you in drafting the deed and getting the property transferred in your name. If the property is solely transferred in your name, then your older sister won't be able to claim any rights over that property.
