situation ; mother quitclaims home to two children, she is in a nursing home. she is unable to pay the nursing home so she applies for Tenn Care and is accepted. She gives TennCare her Social Security check and they pay the tab 4000 dollars a month. She passes away. Can tenn Care put a lein on the home that she had quitclaimed. Her stay in the nursing home was about 36 months. Would like a title or deed to home .lawyers say with out a Tenn Care release or wavier a title company would not give a clear title. The tenncare can put a lien on the property. As far as I know, there is a look back period of 3 years i.e. any property transferred within the past 3 years of applying for tenncare would be subject to a lien by tenncare.
