Mark is correct. One has to stay in the property for at least 10 years before he can qualify for adverse possession. But this is the law for property with color of title.
Know more about Color of title before you proceed to get qualified.

I have live in a small town and in the back of my yard there is a piece of land that belongs to the city but I've been mowing it for 15 yrs. I kinda have my cement drive on a small part of it. Can A person take adverse possession on a city owned property and if not, can I sell my property with a little bit of the drive way over lapping on the city property line?

Hi Joann,
By Law, a person cannot claim adverse possession against property owned by city or town, federal government, or any agency. And, I don't think you can sell city property until and unless you take permission from the City Council.

i bought a home 2 years ago,had the land surveyed,saw that the man behind me had parked his car and made it his driveway 6 Ft i confroonted him that i would be putting up a fence around my property. he acknowled that his driveway was my land and asked if he could buy it from me. i got a lawyer came up with a price and he declined he wanted me to grant him an easement so that he could remain parking there. i came up with a small price to cover taxes anfd liability and explained that it would only be for as long as he owned the land. he agreed than the last minute he wanted it changed to permenant ownership and i said no. i asked the builing inspector and he said to just put up the fence. i took the 6 ft driveway piece went in 6 inches from the markers and now i received a letter from his attorney he claims adverse possesion. what do you think.

Adverse possession is allowed only after someone uses the land for a specified number of years.

Your neighbor may have the right to adverse possession but this will depend on the time period for which he has been using the land.
Anyway, you can check the Adverse Possession Period from our previous discussions and find out if at all you have a chance to lose the property. And, accordingly you can consult an attorney regarding this issue.

In New York the adverse possesion period set is of 10 years, if it is been occupied for the last 15 years then they can put a claim on it.

One has to occupy as well as use the land for the past 10 years in order to claim adverse possession on a property in New York.
we are possesing a land durind 52 yesrs.now the actual owner claiming for this.are we claim for this laws under adverse possesion laws
If you have paid the property taxes and the maintenance fees of the property during these years, then you will be eligible to claim an adverse possession.
hey, out here in my semi-rural neighbrohood could me and a freind just take a abandned home or lot and claim it as our own (while waiting 7 years) just by mowing the lawn, planting tress etc? and is two people attempting to adverse posses together go against the exclusive ownership part?

Apart from the maintaining the property by mowing the lawn or planting trees, you will also have to pay the property taxes for a certain period of time which may vary from state to state, to adverse possess the property.

what is the determin factor in adverse land possesion
