Removable Items from home going to sale

Posted on: 20th Jun, 2011 05:18 am
We added a deck to the side of the house, but the original steps from the door are still under the deck as they were when we bought the home. Can we take our deck ?

Can we take the refrigerator and stove that we bought? We paid cash for the stove, but are still paying on the refrigerator.

Please advise.
Hello,

Anything that was purchased for the home and was "attached" to the property, goes from personal property, to real property once attached to the property. Deck, appliances etc. are all "attached". You can place what items you wish to keep such as the refrigerator in the listing agreement, that way it is completely disclosed to the prospecting buyer. If you do not disclose, and the buyer expected the items you took, they can sue or negate the sale.
