I LIVE IN THE STATE OF ARIZONA MY BOYFRIEND AND I HAVE A MORTGAGE AND I AM THE CO BORROWER. WE ARE GOING TO SPLIT UP BUT MY NAME IS NOT ON THE TITLE OF THE HOUSE. DO I EVEN HAVE ANY OWNERSHIP OF THIS HOUSE AND IS THIS LEGAL? I AM ALSO WANTING TO GET MY NAME OFF OF THIS. HOW CAN I DO THAT?

Do you want to have your name on the property? if you want to have then you need to tell your boyfriend that he should quitclaim the property for you alone but then you need to pay some lum sum amount to him.

hi sillyr,

if your name is not on the title to the property you cannot claim any interest in it. you do not have any legal right to the property. if you want take your name off the loan, your boyfriend will have to refinance it in his name.

it's helpful to actually read what the original post says. the poster said they're breaking up and she doesn't desire ownership of the property, nor to be a party to the mortgage.

poster - you are a party to that mortgage until such time as it is paid in full, unless your boyfriend refinances the loan. you can check with the local tax office to ascertain whether you are shown as an owner of the home.

You want to split ownership then first you need to talk with your boyfriend and might be paid some amount .
