I recently found my landlord is in trustee sale.

My landlord offered to lower our rent back in September 2009 for 6months. I paid September, and October. I have emails to this fact. I had some hard times in the past(father of my twins left us) and I always paid what I could. I have emails from the landlord saying, do not worry about the back rent now, pay what you can. They have been extremely helpful to my situation(Heven sent). I just happened to check the recorders office on the home here as the landlord had told me she might want to sell, and found out in November, they are in forclosure with a sale date on March 15th. That is exactly 6 months from the time they offered to lower my rent? I dont knw if they even paid the lender my payments or kept it. I have not paid for November or December, and just lost my job with two baby girl twins 16mos. and my 14 year old son. I havent told them yet. and Im very scared, not sure what my rights are. Can they legally kick us out? Should I call the lender and will they talk with me??? Worried in Arizona

Welcome to forums!

If you do not pay the rent, then the landlord has the rights to ask you leave the property. In this case, as the landlord is facing foreclosure, I would suggest you to make arrangements for your residence in some other place. You may speak to the lender but I don't think it would be of any help in this case.

I mean they are not even paying the bank and they still have rights to kick me out? Isnt is by law they must notify me when going into forclosure. what am I going to do. Im so scared to call them

Hi mindita,

Though they are not paying the lender but they are still your landlord and thus have the rights to ask you to leave the property if you do not pay the dues. However, they should have informed you that the property is in foreclosure. You may contact their lender and can check out if you can pay the rental dues to them. This may help you in staying in the property until a new buyer purchases the property.
