Company Loan Type APR Est. Pmt.

attorney mess-up

Posted on: 03rd Jun, 2012 10:19 am
I filed a bankruptcy in 2009...which was dischared in May of the same year. I re-affirmed on my home loan and car loan. Recently, I applied for a personal loan thru my bank and was told I do not have enough credit. My credit report shows payments being made to my car loan only. The mortgage company shows my account as current but no pay history.......not hurting my credit, but not helping either. Long story short, my mortgage company had not received re-affirmation papers on this loan. The bankruptcy attorney I used is saying it was my responsibility to get those papers to my mortgage company. When the mortgage company pulled the "docket" from the court, it shows no reaffirmation for them.... I am at such a loss. Attorney is not being helpful and the mortgage company says they cannot do anything without the right paperwork. It has been 3 years and I have been making on time payments this whole time. I need this to be reaffirmedin order to re-establish credit....is it possible? Pros and cons? Also, I pulled my personal banckruptcy paperwork and it shows that I re-affirmed on both. Please help......[/quote]
Hi tkg,

You may have to re-open the bankruptcy filing in order to reaffirm the loan. You should contact your attorney in this regard and take the required steps to reaffirm the loan.

I agree with what Adonis has said. In order to know all about reaffirmation of loan in bankruptcy, you can check out the given page: http://www.mortgagefit.com/secondloan/ch13-reaffirmation.html .

Feel free to ask if you've further queries.
