I filed Chapter 7 3 years ago due to a Botched Medical Surgery and Lost my job and then busted my spine. I was told by my attorney not to reaffirm my mortgage immediatly because my partner was the one making the payments on the house and I did not know what the future held for me relationship wise or what my Medical state would turn in to. Well, it is 3 years later and I am building my credit and I have not worked this entire time and will be out of work atleast another 7 month's. Most importantly; I have made perfect payment's on my mortgage(thanks to my partner) and I do not know if I will be able to make the same income due to my medical conditon and I want to reaffirm my Mortgage debt to start getting even better credit. The Home is only in my name and my partner has bad credit so, I'm wondering if I have to show financial proof that I can reaffirm my mortgage to my lender ; knowing that I have paid perfect on time payments, taxes, etc.? In short, will I have to show proof of annual income to reaffirm my debt?
Welcome kellydawn,
If you want to reaffirm your mortgage, you'll have to re-open your bankruptcy filing. As 3 years have passed since your bankruptcy filing was discharged, it will be difficult to re-open the bankruptcy now. I will suggest you to contact your bankruptcy attorney and check out if he will help you in re-opening your bankruptcy filing.
