car loan during chapter 7

Posted on: 02nd Mar, 2011 05:23 pm
i had filed for chapter 7 bankruptcy in november 2010 due to getting buried with 2 houses in the real estate market. the original dismissal date for the bankruptcy was feb 28th. my husband who filed with me added 3 more debtors after deceiding to close his business. i am trying to buy a different car to surrender the expensive one and buy a much cheaper car. however, the (only) lender cac had held off the car closing because they are waiting to hear from the court that it is dismissed. i am afraid that the dismissal will be pushed back because my husband added these. what am i up against and am i going to loose out on this car? can i still get a loan if the dismissal has been delayed? please help.. the car i am surrendering is being taken in 2 weeks. :(
Welcome hmargherita,

Unless the bankruptcy dismissal is final, the lender will not be ready to close on the car. You should contact your bankruptcy attorney and ask him to speed up the process. You will not be able to get a loan unless the bankruptcy filing is dismissed.
