Welcome tomsdiscountautos,
You've mentioned that your credit cards have been charged off. In that case, you may not be able to get a cash advance and put it in your bankruptcy filing. Nevertheless, you should contact your bankruptcy trustee and attorney and try to take their opinion in this matter.

A chargeoff happens when ther e are 120 + of no payments..at that time the cc company writes it off and puts it to a 3rd party collections agency. At that time you cant do anything with the card.
now if your queston is yo HAD a $38,000 cash advance on that card and want to know if it can be included in a BK then perhaps a Chap 13 repayment plan. Your attorney would know better but I seen high cash advance cards be denied for a Chapt 7
