I recently filed a petion in the state of VA for Chapter 13 to keep my house from being foreclosed on. The property in question is not only in my name, but another persons as well. Is he required to file as well... or can it just be done in one persons name?

There is a special automatic stay provision allowed for in Chapter 13 that protects co-debtors. A bankruptcy court would have to authorize a creditor to collect a consumer debt for your home from a co-debtor. Please consult with your attorney about this provision.
