Hi,
I live in a home that has recently been auctioned. I am a tentant in the home. Prior to this the home was in foreclourse. The owner told me he refinaced the house and that he is making mortgage payments now. He higher my rent also. Then about a month after this The house was auction on april 22, 2010 and was brought by a indiviual. The previous owner told me that the auction was not vaild and he is keeping the house. He said he file Chapter 13 on the 22nd. The same day the house was auctioned. He asked me for my rent on May 1st, 2010 and i gave it to him. Being he said he was able to keep the house. He also asked me for my rent for next month early. Around a week before June and i told him sorry i can't. Now my question is this. Does he still make mortgage payments every month after filing chapter 13? or does he have to wait to go to court and see what he has to pay and how much? Does the mortgage payment every month change now that he has filed chapter 13? I honestly think that there is no mortgage payment due now and that he has to wait to go to court and see what they will be. The closing still hasn't happened and when i call the courts they still tell me that the house was sold. The person who brought the house came to my home and told me he doesnn't want any rent from me. He said he buys and sells houses and when the time comes for me to move he would give me more than enough notice. I don't know what to do anymore. Should i pay rent to the previous owner? Is he making mortgage payments? Does he keep the house? i'm not familar with any of this. Pleasee can you get back to me and let me know how thisall works and what i should do. Welcome to forums!

You need to first check out whether or not the property has been sold off at the foreclosure sale. If yes, then you should pay the rent to the new owner and not to the previous one.

If the property has not been sold off at the sale, then the previous owner will still be considered as the owner of the property. Under the Chapter 13 bankruptcy filing, the owner will have to make payments as per the repayment plan to the lender. If he makes the payments on time, he will be able to keep the property.
