my husband filed for divorce in august 2012. prior to our separation, we filed chapter 13 bankruptcy and our home (which is upside down) was not included on the bk....he then listed it for a short sale and we got an offer....then citibank stopped the sale, saying the house was included on the bk. now, he has put a hold on the divorce, and wants to convert the chap 13 to a chap 7. we have a bk attorney, i just feel as if we were misinformed and a little suscipious that he put the divorce on hold.....any advice?

I don't think it is mandatory to put an hold on divorce in order to convert Chapter 13 into Chapter 7. Nevertheless, it is your bankruptcy attorney who will be able to help you better in this regard.

Once your plan is approved by the court, you will continue to own any property that you yourself do not sell. Your actual payments go to the bankruptcy trustee, and the trustee distributes the money. When you complete all payments mandated by the bankruptcy payment plan, the court discharges your debts.
