i stumbled across this sight and i would like to try it! i signed a quick-claim 6 years ago to give my ex husband the property and home. he was supposed to refinance it in his name only, but never did. he told me he is filing a chapter 13.....will the bank come after me since my name is still on the mortgage papers? and if they come after me----am i able to jump in and go ahead and have them sell the property?
Hi tamorah,
As you are not filing a bankruptcy jointly with your husband, the trustee won't come after you for the mortgage payments neither the filing will have a negative affect on your credit report. As your husband is filing Chapter 13, he may get a repayment plan to pay off the dues.
