REFUND IN CHAPTER 13

What happens to money that has been paid into the trustee but not distributed to the creditors if the chapter 13 is converted to a 7?

as per the laws, any money paid to the trustee should be distributed to the creditors even though the debtor converts from chapter 13 to chapter 7 bankruptcy.

Hi CP,

Welcome to forums!

Whether you convert your bankruptcy from chapter 13 to chapter 7, you will have to distribute the money to the creditors.

I was told by my lawyer that monies not yet sent to the creditors will be refunded to me. Filed c13 in last year and converted to c7 6months later. No monies have been dispursed to anyone.

I would suggest you to contact your lawyer and discuss the whole issue. He will be the best person to let you know why the money was not refunded to you.
