My husband is stuck between a rock and a hard place he has been divorced for two years and bought his ex wife a vehicle which she had repoed n ow because he was the co sighner they are coming after him for the remaining balance on the loan if he proceeds with this bankruptcy should he include this or not. I feel she should have to pay this because it was done on purpose
The creditor can come after your husband for the deficient amount as he was the co-signer for the loan. As his name is on the mortgage, it would be his discretion whether or not he would include the mortgage in his bankruptcy filing.
