i have currently filed chapter 7 bankruptcy and have fallen behind in my mortgage payments but have been making good faith payments to an account with my mortgage lender and when the amount reaches the amount of a payment they apply it to my home mortgage. yesterday my lender filled a motion to be excluded from my bankruptcy and move forward to foreclose! i called to make a payment yesterday and they refused to take my payment but today i called and they accepted my partial payment....i have contacted my attorney and he is out of the office today in court and his associate told me there is a possiblity i could still loose my home!!!!! im a panic here!!!! and cant find any answers till monday when my attorney returns!!! if i get my mortgage current does anyone think they will stop the foreclosure on my house??? please someone help !!!!

I'm certain that if you get current they will drop the foreclosure. They want your payments not your house.
We go to court next week and we are current on our mortgage now but still have to go to court where they had filed the motion. Our attorney told us that we need to pay their attorney fees if possible before we go to court but at 900 bucks attorney fees for filing the motion will be hard for us to make the full payment before next week. Do you think this will have any effect on the ruling if it is not paid in full ...the attorney fees that is. Thanks

If the attorney fights your case properly, then it will not affect the judgment. But as you won't be able to pay the money, I doubt whether he will fight the case for you. You can speak to him and request him to fight for you. Tell him you will pay the fees as soon as you are able to.

I hope my attorney will fight for me since he has been paid, I have him paid in full for my BK case it is the mortgage company attorney fees that I will not be able to pay in full before we go to court. shew......Im worried

Is your bankruptcy attorney fighting the case for you? If yes, then I don't think there will be a problem as you have already paid him in full. In case of the mortgage company attorney, I think you should speak to the lender and tell your situation. The attorney might consider your case.

Yes my BK attorney is representing me in the matter. I am going to make my Nov payment today and I will talk with them and let them know I will pay the attorney fees in full but it might take me a few weeks and I can pay a couple hundred down today on the mortgage attorney fees but not the full 900 bucks. I hope they will work with me because I have to much time and money invested in building my house and cant stand to think I might loose it just because I have gotten in a bad situation financially. Thanks for the advice
