My chapter 7 is being dismissed because I refiled too soon

Hi, I filed a chapter 7 back in aug 2004. however, i filed a chapter 13 in march 2012. I then converted the case to a chapter 7. I have a motion objecting the discharge on the 10th of Jan. the question I have is on the 10th of Jan when my case is dismissed can I refile right away? It will be past my 8 years timeframe to be discharged in a new case. Would I have to wait 180 days to refile a chapter 7 after I get dismissed in this case?

Unless the 8 years timeframe gets over, don't file the bankruptcy Chapter 7 again. Have a word with your bankruptcy attorney and get to know his opinion in this regard.

As the case was dismissed, I think you will have to wait for 180 days before filing a new one. Nevertheless, you should get in touch with your bankruptcy attorney and he will be able to help you in this regard.
