looking to move into a home with my family. I will be letting my home go back on foreclosure - i filed ch 7 in 2005. what bankruptcy can i file to keep the mortgage company coming back on me? when should i file?

Rather than letting the home go into a foreclosure, you can contact the lender and apply for a deed in lieu of foreclosure. In this process, you won't be liable for paying the deficient amount resulting from the sale of the property. Thus, you won't have to file bankruptcy in order to prevent the lender from suing you.
