I filed Chapter 7 and was discharged I was the primary owner. My ex-wife was awarded the house and she never refied the house in her name. Now she is behind 2 1/2 going on 3 years. Will my name ever be taken off since I was discharged and will she be able to stay in the house? Or can she modi? even after the bankruptcy?
hi tellezrosie,
though your chapter 7 bankruptcy was discharged, the property would remain in your name and the lender will still hold a lien on that property. it's quite surprising to me that the lender has still not foreclosed the property though your are more than 2 and 1/2 years late on mortgage payments. if your name is on the mortgage docs, you need to speak to the lender about a loan modification. however, there are high chances that the lender would foreclose the property.
