I have on my chapter 7 documents that I am keeping the house and I filed 4/1/09 it has not been discharged yet, I was told around August or September 09' by trustee. The lender has NOT yet sent the reaffirmation agreement for the house. My attorney said if they don''t send it , the mortgage is not reaffirmed and I am not responsible for the debt. I pulled my credit on 6/1/09 out of curiousity and my mortgage shows current while all other debts indicate included in bankruptcy or chapter 7 bankrtuptcy. If I don''t sign the reaffrimation will my mortgage finally show after discharge that it was included? I am worried that the status of the loan will stay "current" even after my discharge even though it should be included in the bankruptcy if i didn't sing the agreement. Is that possible?

If you do not sign the reaffirmation agreement, you are not personally responsible for the mortgage. In such a situation, you'll have to surrender the property to the lender or else the lender may foreclose it. I would suggest you to contact the lender and check out why they are not sending you the reaffirmation papers. It is always better to reaffirm the debts as it will help you in saving your property.

As far as I know, if you have included your mortgage in the bankruptcy and got it discharged, it won't be considered as an active account.

You can have it removed from your credit report by calling the credit agencies directly. I am in the process of having ours removed. Discharged in our BK in Jan. 09. Or dispute the item on all your reports and the agencies will pull your BK.
