if i pay spousal support, will that help me qualify for a chapter 7 bankruptcy. in other words without spousal support payment added to means test i fail the test. but when i add my court ordered spousal support the means test shows i pass and can file chapter 7
you can add spousal support as your expense. they may ask for divorce proof
The debt payment deductions include the 60 month average of any tax, child support, spousal support or other priority claims. This is deducted from your current monthly income. You need to check out with your bankruptcy attorney whether or not you qualify the Means Test after this deductions. He would be the best person to let you know about this.
