Our first is trying to sue us for short title after they sold the home that was foreclosed on us. We have filed a chapter 7 and included the 1st and 2nd without reaffirmation. We received our discharge for the chapter 7 on the 21 of October, 2009. What are they suing us for?
Hi swanberg,
If you had included the property in your Chapter 7 bankruptcy filing and did not go for a debt reaffirmation, then the lender would not be able to sue you. You must be having the discharge documents. You can show them to your lender and ask them to stop harassing you. Or else, you can contact an attorney and he can help you in this regard.
Thanks

Thanks, I spoke to my attorney today and that is exactly what he said. Thanks for the reply and the good advice.
ensure to reaffirm as soon as possible. note that it has to be done in agreement with lender
