What happens when bankruptcy 13 has been dismissed by the Tr

I just received a notice that my bankruptcy has been dismissed by the Trustee. I haven't even had a meeting with the trustee therefore I don't fully understand what's going on. If anyone recalls I filed bankruptcy to keep my condo from being sold at a sheriff's sale. Do anyone have an idea as to what happens now?

The only reason that I know that a trustee will dismiss a bankruptcy, is when the payment agreement has been violated. My suggestion is to contact the Trustee immediately and see the status. If you intention is to re-initiate the bankruptcy, you need to act quickly. It may not be possible, but you won't know if you don't ask.

You should contact the trustee immediately if you want to reinstate the case. You will have to pay for the missed payments then. But if you do not take immediate action, the court may close the case. If you want to re-open that, you will have to pay the filing fees once again.

Once the case is dismissed, you will lose protection from the court against creditors and they might come after you to recover the unpaid balance.

This means that the chapter 13 is no longer in effect. I would contact your attorney that handled the bankruptcy for you to give you your options.

What happens to the unsecured debts when your case is dismissed. Also what if an emergency happens that cause a problem

Hi dorothy,

Your creditors will be able to come after you in order to collect the unsecured debts in full. You will lose the protection of automatic stay that you had received when you were in bankruptcy filing. In case of emergency, you can apply for a hardship discharge if your case is not dismissed yet. Nevertheless, you should speak to a bankruptcy attorney and he will be the best person to help you in this matter.
