Motion to Dismiss

Posted on: 27th Aug, 2010 04:45 pm
The trustee filed a motion to dismiss my Chapter 13. My attorney said all I needed to do was get current and it would be fine. The trustee cashed the money orders that got me current on a Monday. The trial was on Tuesday; I came home on Friday and had a letter from the attorney showing my Chapter 13 was dismissed. If they got the money why was it dismissed? And now I am out of all that money trying to move since the Chapter 13 was dismissed?
Hi mthomas!

Welcome to forums!

You've mentioned that the trustee filed the motion to dismiss your Chapter 13. I guess the trustee had not withdrawn the motion to dismiss after he received the required dues. That might be a reason why your bankruptcy got dismissed. You should immediately contact the trustee and the bankruptcy attorney in this regard and check out what you need to do.

Feel free to ask if you've further queries.
