Can I switch to a 7 from a 13 due to financial hardship of adult child and 2 children living with me?

You can convert your chapter 13 bankruptcy into chapter 7, if you are not being able to make payments as per the chapter 13 plan. You need to qualify for chapter 7 bankruptcy. Thus, you will have to take a new means test to determine whether you qualify for chapter 7. If you qualify and decide to change to chapter 7, you will have to file a notice of conversion with the bankruptcy court and pay a certain amount of fees. Your creditors will also have to approve of the conversion.
However, you will have to prove that you are in a financial crisis to qualify for this conversion to chapter 7. The financial hardship also needs to be due to reasons for which you cannot be held liable, for instance serious illness, loss of job etc.
