my chapter 13 bankruptcy was discharged about a year ago, my house was listed in the bankruptcy, however i'm still in the house but i have not paid a mortgage. my credit report show a $0 balance owed to the lender. my question is will and can the lender still go thru a foreclosure process and will it reflect on the credit report and score?
Your next call should be to your bankruptcy attorney. Unless you paid the lender in full during the Chapter 13, you still have a mortgage for which you are obligated.
The only thing working in your favor is that most lenders are so swamped with foreclosures they haven't gotten to you yet.
Even though there is an error in reporting on your credit report, I suspect your mortgage will be coming back to bite you.
Call your BK attorney.
Good Luck

No the bank can not do a foreclosure. Are you wanting to stay in the house? I would recommend filing your paperwork for a loan modification.

Forgive me if I'm wrong but isnt the purpose of a chapter 13 to wipe out your debt to all lender assuming the lender is list in the Bankruptcy. If so, then the credit report in not errored... and if I dont owe the lender how can they forclose on the home when there is no amount due
And I apoligize, I mis-spoke it was a chapter 7 that I filed
Hi pfb,
Though your mortgage is discharged in your Chapter 7 filing, the lender still holds the lien on the property. So, if you do not pay off the dues, he would foreclose the property. As far as I know, the foreclosure would be mentioned in your credit report.
