Filed a Chapter 13 But the Home Equity Is Not In My Name....

Posted on: 10th May, 2010 09:32 am
my lawyer filed a chapter 13 for me but the home equity loan (which was the reason for filing) is in my soon to be exhusbands name. my lawter was aware of the loan not being in my name and still filed. my ex has taken over the payments but it is still in my name and i want it taken out of my name. can i do this? also, my income has dropped considerably since i filed because of illness and i can not return to work. if i can't get the chapter 13 out of my name do i have any other recourse in the matter?

Hi starfire!

Welcome to forums!

Do you want to dismiss your Chapter 13 bankruptcy filing? You need to contact your bankruptcy attorney for it. As far as the home equity loan is concerned, it won't be included in your bankruptcy filing as it is not in your name.
