My loan servicer does not have a program to due a Loan Mod while we are in CH13. We have been given approval from the Trustee and have a letter from our Attorney. We also qualify for the Loan Mod. What do we do?
it is strange that your lender does not have refinance service in his portfolio.
you speak to other mortgage lender & try for it. i hope you will be current in payments.

hi tonkatoy,
if you have filed for chapter 13 bankruptcy, the lender will have to give you a repayment plan so that you clear off the dues. under this repayment plan, you would be liable to pay off the dues within 3-5 years. however, this repayment plan is not similar to a loan modification. didn't the lender give you the repayment plan to clear off the dues?
take care.

If you carved out the home from the CH 13 you should be able to get a loan mod?

Tonka, you may want to double check the HAMP program reports and see if your servicer shows up anywhere. Most of the major servicers have received money from HAMP so unless you're dealing with a fairly small servicer you might do well to be a tad skeptical until you do a little digging.
You can find the HAMP participants on the last pages of the TARP reports listed at financialstability.gov under the "Reports and Docs" tab...
