Property Surrender while in a 13

Posted on: 04th Aug, 2010 06:43 am
we are currently in a chapter 13 bankruptcy plan for another 2 years. we have tried to sell house and were unable to do so, at least for a reasonable amount.

my question is this. if we agree to surrender the property as part of our 13, will there be an additional report on our credit? i was told that since we are still in the 13 repayment plan that it would just be listed as part of the bankruptcy and not a second ding.

anyone know for sure?
Hi bkarchery!

Welcome to forums!

If you surrender the property to your lender, then I guess, it will be reported in your credit report. However, it'll also depend upon your lender whether or not he would report it to the credit bureaus.

Feel free to ask if you've further queries.
