If my fiancee ex wife files chapter 13 but signs a affirmation on the house could they come after him at all. his name is still on the house even though his divorce papers say he is not held liable for it. He also signed a quick claim deed but like I said his name is still on it.
Hi kelle,
If the ex-wife is reaffirming the debts, then she will become personally liable for the dues. In that case, the lender won't come after your fiancé for the dues. However, if your fiancé's name is on the deed, then he will be liable for the dues unless she refinances the mortgage in her name.
