my wife, and i signed a quitclaim to transfer ownership to a friend of hers, and she was supposed to take out a loan to take it over, but she did not, but she has been paying the mortgage, now she wants out and is stopping payment. i am already in a chapter 13 bankruptcy. what do i do, i cannot afford this house.

If the mortgage is in your name, then you would be responsible for the mortgage payments if your wife's friend stops the loan payments. You can contact your bankruptcy attorney and and check out if you would be able to include the mortgage in your Chapter 13 bankruptcy now.

Would we be able to convert to a Chapter 7?

As far as I know, you'll be able to convert your Chapter 13 into Chapter 7. However, in order to do so, you'll have to contact your bankruptcy attorney and take the required steps.

Mainly one converts chapter 13 to chapter 7 because of inability to make plan payments for chapter 13,inability to make car or house payments after the plan is commenced or to get the case over with. The best thing would be to consult the bankruptcy attorney who is handling the case. Make sure you met the eligibility. The only requirement for converting chapter 13 to chapter 7 is that the case has not previously been converted.
