If there is joint property and only the one party filed chapter 13, does this prevent the sale of the home?
Hi lizzy,
Unlike in Chapter 7, in bankruptcy Chapter 13 you do not have to sell your home to pay off your creditors. Thus, there should not be any problem for you to sell the home. But when you sell the home the mortgage must be paid in full. However, it is always better to consult a bankruptcy lawyer in this regard as he would be the best person to help.
