What happens when a married couple is in Chapter 13 and they decide to convert to chapter 7, but only one is able to convert and the other is not because of a previous bankruptcy and the time limit is not up? The spouse who cannot convert has lost their job also and can no longer afford ch. 13 payments. What are the options? Thanks.
hi jmille!
welcome to forums!
if a person does not meet the requirements of chapter 7 bankruptcy, then he/she won't be able to convert the chapter 13 into chapter 7. both of them should have a word with their bankruptcy attorney in this regard and take his/her opinion regarding this.
feel free to ask if you've further queries.
