CHAPTER213 VA LOANS

Posted on: 13th Feb, 2011 09:49 am
I am currently in a CH13 and am a military spouse. My husband and I are being moved under military orders which is going to cause me to be out of work. I have a house in Florida which is currently not included in my bancruptcy but I will not be able to make the payments when we are relocated. My main concern is that the loan is backed by VA and that they will come after us. Can this house be included in my existing CH13 and can my CH13 be changed to a CH7 due to military orders to move causing me to lose my job? I am o.k. surrendering the house to the bank. I do not want to keep the house.
I forgot to mention that the property in Florida is being rented out right now but my renters move out in a few months which is why I will not be able to keep up with payments. Also...because of the economy, renting the property again is a long shot and will be at a great loss every month.

Welcome BEAKER,

You should immediately contact your bankruptcy attorney and check out what steps you need to take in order to include the property in your bankruptcy filing and how you can convert Chapter 7 into Chapter 13.
