We filed chap. 13 a year ago. We re- afirrmed our 1st mort but not the 2nd. We still pay our 2nd each mo. but they say they can not send us a statement or contact us at all. Our house is not worth what we owe on it now. We need to get out from under the two mort. What happens if we just quit paying both mort. and move out? Our we responsible for the 2nd mort. They are both up to date.
We owe a total of about $140000 and our home is valued at about $110000.

Hi wayleecothren
You have already filed ch.13 and court has devised a special payment plan for you in order to ease the repayment now if you walk away then the whole purpose of filling BK is lost as you have already hit a big on your credit so why to walk away.
Instead ask your attorney to convert chapter 13 into chapter 7 and it is very much possible and you will get a immediate fresh start in your life without (or with little) debt on your head.
Feel free to ask any further query if you have.......
