I filed chapter 7, the only loan that shows on my credit report is my 1st, I do not see the 2nd or 3rd other than they have been discharged, yet again the 1st was not discharged. Does this mean I can just pay 1st and keep in my home and not pay 2nd and is there a time period to where I can get my liens back. So many people tell me many things. Like I can keep my home on 1st for a long time, not sell it...help

as far as i know, if you file chapter 7, you will have to list all your assets and include all the mortgages on your property. it is quite surprising that your second mortgage got discharged while your first mortgage still shows up on the credit report. have you reaffirmed your first mortgage while you were in bankruptcy? if you had reaffirmed, then you would be responsible to pay it off and thus it may be showing up on your credit report.

i have 'not, reaffirmed anything....is there a certain form when you re-affirm or is there a way the banks know that I don't ...eg..continue payments...what is reaffirming actions?

While the bankruptcy proceedings are ongoing, you will have to fill out the reaffirmation documents. This will make you personally liable for the debts. However, if you do not reaffirm but continue making the payments, the lender will not foreclose the property.

You can contact your lender or your bankruptcy attorney in order to know whether or not you have reaffirmed your debts.
