I filed chapter 7 in 2003. I don't want to foreclose my house but I am having difficulty paying it due to credit cards with high finance charge that I am paying also. I am still current on my mortgage as well as all my credit card payments but is scared of what next month will bring. My question is , can I apply again for bankruptcy even if I have applied back in 2003? How often can you apply?
With the new laws, you have to wait 8 years for Chapter 7. I filed 4/22/02 and just had to do it again yesteday, 4/26/10. You can file Chapter 13 without waiting for the 8 years to pass.

Thanks for the reply. Is there a limit on how many times you can apply bankruptcy in a lifetime?....and how much is the charge now to file chapter 7?

hi liliab,

you will have to contact the bankruptcy attorney in order to know the charges to file chapter 7. you will be able to file chapter 7 every 8 years after a previous chapter 7 filing and 6 years after filing bankruptcy chapter 13.
