We filed chapter 7 in 2006 we reaffirmed our mortgage, but due to job loss of my husbands 30 year job in 2008 the bank was going to foreclose us. during the foreclosure the case was closed and the bank charged off our mortgage. We are still here and the bank wants us to make payments to a cashiering service and not receive a statement , just a 1009 at the years end. What do we do?
Hi jandk,
If the mortgage lender has charged off the loan, then their collection agency will collect the dues from you. This charge off will have a negative effect on your credit report. You will either have to negotiate with the collection agency and pay off the dues. You can even contact the lender and ask him to bring back the account from collections and negotiate with him for a settlement plan.
Thanks
