Hello, Im new here it seems info and help is great. i just filed chpter 7 Bk Dec of 09, it seems i had to include my Condo that ive had for 5 yrs to start do the process, is there anyway to save my condo through any loopholes or homestead exemptions? im in Nevada property with,NoW! 84,000 was 210 4yrs ago. can i still reaffirm or negotiate with trustee or is it too late.
You can reaffirm your mortgage by signing the debt reaffirmation agreement with your lender. This will help you in saving the property. After signing the agreement, you would become personally liable for the mortgage dues once again. You will have to make regular payments to the lender in order to save your property from foreclosure.
thank you for your answer, what if the property was in the writings in the BK 7 would we still be able to do the reaffirmation? we havent gotten anything from our morgage company concerning the property not even a default notice, my fiance she had gotten a regular payment stub in a letter for the condo payment? I thought the Attorneys and the court had contacted them about that. is some new law. the Bankrucpty was started nov 20,09 and completed court hearings and all by feb 15, My fiance was terrible sad about the whole thing then i ran across another individual writing about an experience so i wanted to comment and search for answers

The mortgage is reaffirmed when you are in bankruptcy. If you haven't reaffirmed the debts, then you'll have to re-open your bankruptcy filing and then reaffirm the mortgage.
