i recently filed chapter 7 it has been discharged including my first and second mortgage i am hugely upside down with my home i am trying to get help from the first mortgage company with the hamp program it has been since june 2010 nothing yet i am behind in my first mortgage payments but not my second , should i not pay the second and just pay the first? i am not sure of what to do just having a hard time making ends meet.
Hi maidsareus,

As you've been discharged by the bankruptcy court, you're not personally liable for the mortgage payments. If you do not pay the dues, the lender won't come after you to recover his dues. But he can always foreclose the property. However, after the foreclosure, the lender will have to satisfy the mortgage dues of the first lender before he can recover his dues.
