So nice to have this avenue to ask questions as I've found it very difficult to find some types of answers.
1st & 2nd mortgage included in Chap 7 discharge in Dec 2010. No reaffirmation. Still currently living in the home until the home goes to auction next month. We have not made a mortgage payment since the discharge. Since we have not made any payments during that time we don't know if the yearly home owners insurance had been paid or not. If it has been and we've not contributed to that fund are we liable to repay and are we liable for any property taxes for 2011 up to the sale of the home at action?

As far as I know, unless the property is sold off in the auction, you will be considered as the owner of the property. Thus, you will be liable for the maintenance of the property. As a result, you may have to pay the home owners insurance.

If the unpaid HOA dues or taxes are still unpaid for the auction, then the sale of the home will satisfy the taxes. The unpaid HOA could turn into a judgment and lien against you if not satified through the sale of the unit. Good Luck
