We just filed Ch. 7, we did not re-afirm our mortgage, we were told we could not by our attorney as we were late on our payments, even though we had been consistantly working on a loan modification. We had our 341 hearing this week, than spoke to our mortgage company and they would like to try to negotiate with us, my attorney said we could not do this. Do we have any options?

If you want to reaffirm the mortgage, then you can have a word with your mortgage lender. If the lender agrees to your request, then you will be able to reaffirm your mortgage debt and save the property by paying the dues on time. You should note that once you reaffirm the loan, you'll become personally liable for the mortgage.
