chp. 7

My ex wife has threatened to file chp. 7. Our marital home went into foreclosure shortly after our divorce became final. I have since remarried and wonder how my ex filing chapter 7 could affect me now.
If you just want to get a discharge from all debt, and you don't mind losing any property that serves as collateral for a debt, or if you are current on debt secured by property you want to keep and you have a lot of other unsecured debt that you need discharged, then chapter 7 would probably better serve your purpose.

The bank has the right (and the duty to its shareholders) to go after either or both of you at any time. This time they chose to garnish the wages of the spouse that is not under the protection of the bankruptcy court.

hi guest!

welcome to forums!

though your ex is filing chapter 7, it won't affect you as you're not filing bankruptcy jointly with her. however, you may lose the marital home if the trustee decides to sell it off and pay off the creditors of your ex.

feel free to ask if you've further queries.
