chapter 7/divorce/refinance

my husband and i recently filed chapter 7 ( discharge 10/14/09 )........we are currently separated, and i have every intention to divorce. i left the home in which i am primary borrower-husband is secondary borrower....my intention is to let him have the house, however, i want my name removed from the deed and the note. we have since learned that because of the chapter 7.....he cannot refinance for 4 years ( with our current mortgage co.)......to have my name removed.
now, he's saying he'll leave the home....and i can have it.
i'm not sure what to do....as i have relocated ( to be closer to my job ) and have signed a lease ( 7 more months ) for the apartment i'm living in.
please give me some advice................
If your husband has surrendered the property to the lender, then he would foreclose it to recover the dues. However, while the lender sells of the property, he may pay you the amount equal to your share of the property. However, you can contact your lender and check out if you can refinance the loan in your name.
