We filed for chapter 7 and included a property that has a tenant that is obtaining benefits from the state for rent. The discharge was granted last year and we are still receiving checks from the state for rent. Should we cash the checks and are we legally bind to the property.

If you've reaffirmed the debts and paying the mortgage dues on time, then you are still the owner of the property. If you keep on making the payments, you will remain the owner of the property. As far as checks are concerned, I guess you will be able to cash them. However, your best option would be to contact your bankruptcy attorney and take his opinion in this regard.
