I am in a Chpt 13 with my soon to be ex-wife, I am disabled and on Social Security Disability. What paperwork is necessary to apply for me to be moved to a chpt 7.

I have filled out new I's and J's but that is for the chpt 13.

hi ron,

you can definitely convert a chapter 13 bankruptcy into chapter 7. normally, the petitioner's inability to remain current in the chapter 13 repayment plan is the main reason for converting to a chapter 7 bankruptcy. as far as documents are concerned, you will have to contact your bankruptcy attorney. he/she will be the right person to let you know what documents you need to sign.

The attoirney says it is a conflict of intrest as he represents both myself and my ex-wife.

Hey Ron,

Why is it a conflict of interest between you and your ex-wife? Doesn't your ex-wife want to convert chapter 13 bankruptcy to chapter 7?

Nope, she makes way to much money and they won't even think of letting her do that.

I am on SS Disability and my nincome does not count so I need the conversion paperwork so I can file to cut from the 13 to a 7.

Hi Ron,

You will be able to file bankruptcy alone as your wife's income will not let her qualify for the bankruptcy. But do you have joint debts with her?

We are in chpt 13 already, getting a divorce, I want to pull out of ther chapt13 and be processed as a chpt 7. How is this done. I could care less if she has all the bills. She files for the divorce.

Your bankruptcy attorney will be the best person to tell you about this. Both of you should convert the bankruptcy to chapter 7 as both of you have jointly filed Chapter 13.
