Is the creditor right in saying so?

I filed bankruptcy chapter 13 in 2005. One of the creditors did not file for the entire amount of the loan. When I was discharged in 2008, that creditor reported the unclaimed amount as a charge off. Equifax refuses to remove it because the creditor says its valid. I even sent Equifax copies of the bankruptcy showing the account included… Is the creditor right in saying so?

If the debt has been discharged in bankruptcy filing, then the creditor cannot report the unclaimed amount to your credit report separately. You should get in touch with your bankruptcy attorney and check out if he could be able to help you.

You have told that you have already been discharged in 2008. Now, the credotor can't make any sort of claim. You can also take legal help to sort out the matter.
