re affrimation of debt

Posted on: 03rd Aug, 2010 01:14 pm
I have recently filed and have had my banruptcy discharged, my mortgage is not behind. I requested a loan modification which was approved. My attorney advised not re affriming my mortgage, so therefore my motgage lender says the loan modification is only temporary without a reaffrimation. Is this true, my attorney continues to refuse to re affirm my debt with the mortgage company and says his obligation to me is done. I would reaaly like the permanet loan modification, since my entire paycheck pays the morgage every 2 weeks. The mortgage company advise me to reopen the bankruptcy and reaffirm and then sign the perm loan modification. Advise please, what do I do if nothing happens do I just continue my mortgage like nothing happened, can they take my house ??
Hi vjbscottage,

You'll receive a permanent modification only when you're personally liable for the mortgage. As you haven't reaffirmed the mortgage, you're not personally liable for the mortgage dues. If you can afford to pay the loan after a permanent loan modification, then you can go ahead and reopen the bankruptcy to reaffirm the mortgage.
