Is a bankruptcy considered discharged at the confirmation court date if all is approved? I cannot apply for a rent application until it the bankruptcy is discharged. Or will I have to wait the five years?
Hi griffin,
The bankruptcy court grants the discharge on expiration of the time fixed for filing a complaint which objects to discharge and the time fixed for filing a motion to dismiss the case for any abuse. Normally the creditors may get 60 days following the first date set for the 341 meeting in order to object to the discharge of bankruptcy. However, getting a discharge may vary depending upon the Chapter of bankruptcy you file. Also, you would receive documents notifying you about your bankruptcy discharge.
You won't have to wait for 5 years to rent a property. You can apply for a rental property once you receive a discharge from your bankruptcy filing.
Take care.
